Here is the essay prompt: Even though most people who are incarcerated in Canada on any given day are held in a provincial jail, these institutions in general receive less attention – from the media, advocates, courts and governments – than their federal counterparts. What are the practical, institutional, legal, etc. differences between provincial and federal incarceration systems that might lead to more or less attention? Is this difference in attention justified? Why or why not? And what, if anything, should be done to ensure that provincial jails are subject to sufficient scrutiny and oversight?
There is to be some discretion in regard to the prompt so the structure I would like to have is: first, briefly go over the purposes of federal and provincial correctional institutions in Canada. Second, analyze the legal differences between the two institutions and the legal status of the individuals in these institutions. Third, analyze the institutional differences between these institutions, which are predicated on overcrowding and a lack of access to programs for inmates (which has to do with their legal status as well) in provincial institutions, which is the opposite for federal institutions. Fourth, analyze the practical differences between the institutions, which are predicated on a lack of focus, transparency and oversight for provincial institutions, which is the opposite for federal institutions. Finally, provide steps that can be taken to remedy these issues.
Although much of the literature on provincial prisons focuses on ones in Ontario, as you will see in the research notes, thereis literature on institutions in other provinces.
