Number 4 was converted into a small dental practice, and Pip had Ani’s permission to display a sign on the garden wall of number 2 advertising the business. In 2021 Ani sold the freehold of 4 Maypole Close to Pip. Shortly after the sale to Pip, Ani sold 2 Maypole Close to Robin. Robin has taken down Pip’s sign, and the owners of the pub have erected a sign stating, ‘parking for pub patrons only’.
Advise Pip as to whether he can insist on the reinstatement of his sign and whether he and his clients can continue to park in the pub car park.
(b) Suki bought Park Gardens in 2002 and was registered as the freehold proprietor. The house had a large back garden which she sold as a development plot to Pasha, who covenanted as follows:
CO That Pasha and his successors in title would only use the development plot as a single residential dwelling. The covenant was expressed to be for the benefit of the retained part of Park Gardens.
(ii) That Suki shall grant Pasha a right of way over the retained part of Park
Gardens provided that Pasha contributes a proportionate part of the cost of maintaining the driveway.
(ii) That Pasha shall erect and maintain a fence between the plot and the retained land.
Subsequently, Suki sold her house to Cat, and Pasha built a house on his land, which he sold to Eimear. Eimear has applied for planning permission for a further house, has allowed the fence to fall into disrepair, and refuses to contribute to the cost of the shared driveway.
Advise Cat as to whether (a) she can compel Eimear to maintain the fence and contribute to the driveway (b) Eimear will be in breach of covenant if she builds another house and, if so, what her remedy would be for such a breach.
(c) Boris, Clara, Dora, and Ella purchase a hotel. They each contribute equal
amounts of money and buy the hotel without a mortgage. On the TR1 they state that “they are to hold the property on trust for themselves as joint tenants”.
